DMCA Policy – NcCorner

1. Overview

NcCorner respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We may, in good faith, remove or disable access to content suspected of infringing copyright and may limit or terminate access for repeat infringers. Your use of our services remains subject to our Terms of Service, which incorporate this DMCA Policy. Capitalized terms not defined here have the meanings in the Terms of Service.


2. Submitting a DMCA Takedown Notice

If you believe that material available through NcCorner infringes your copyright, please send a written DMCA Notice to our Designated Agent that includes all information required by 17 U.S.C. §512(c)(3):

  1. Signature – A physical or electronic signature of the copyright owner or an authorized agent.

  2. Identification of the Work – A description of the copyrighted work claimed to be infringed, or a representative list if multiple works are involved.

  3. Location of the Alleged Infringement – The exact URL(s) or other precise location information to help us locate the material.

  4. Good-Faith Statement – A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.

  5. Contact Details – Your full name, mailing address, telephone number, and email address (if available).

  6. Accuracy & Authority Statement – A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Notices that are incomplete may be delayed or deemed insufficient.


3. What Happens After We Receive a Proper Notice

Upon receiving a compliant notice, NcCorner may:

  • Remove or disable access to the identified material;

  • Notify the uploader/account holder that the content was removed or access disabled; and

  • Enforce our repeat-infringer policy, which can include suspension or termination of service.

We may retain copies of correspondence for recordkeeping.


4. Filing a Counter-Notification

If your material was removed or disabled and you believe this was a mistake or misidentification, you may send a Counter-Notice to our Designated Agent that includes:

  1. Your physical or electronic signature.

  2. Identification of the material that was removed/disabled and the location where it appeared before removal.

  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.

  4. Your name, mailing address, phone number, and email address.

  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district of your address (or, if outside the U.S., any judicial district in which NcCorner may be found) and that you will accept service of process from the original complainant or their agent.

After we receive a valid Counter-Notice, we may forward it to the original complainant. Unless the complainant notifies us that they have filed a court action to restrain the allegedly infringing activity, NcCorner may restore the material within 10–14 business days at our discretion.


5. Repeat-Infringer Policy

Accounts associated with multiple valid infringement notices may be deemed repeat infringers. NcCorner may restrict, suspend, or terminate such accounts as appropriate.


6. Misuse of the DMCA

Submitting false, misleading, or bad-faith notices or counter-notices can result in liability for damages, including costs and attorneys’ fees, under 17 U.S.C. §512(f). If you are unsure about your rights, consult a legal professional.
